By submitting your application and accompanying materials (collectively, the “Application”) to GSourcers, you agree to the following legally binding terms and conditions.
1. Jurisdiction and Governing Law
The courts of the Republic of Gabon shall have exclusive jurisdiction over any dispute, claim, or matter arising out of or relating to this application process or these Terms and Conditions, including any disputes concerning the collection or processing of personal information. The governing law shall be the laws of the Republic of Gabon.
2. Consent to Personal Data Collection and Processing
By submitting your Application, you provide explicit, specific, and informed consent to the collection, processing, and retention of your Personal Data by GSourcers for the purpose of recruitment and potential employment, in compliance with the highest standards of data protection across African jurisdictions, including the South African Protection of Personal Information Act, 2013 (POPIA) and Gabonese Law No. 025/2023 (amending Law No. 001/2011 on the protection of personal data).
3. Types of Personal Information Collected
The Personal Data collected and processed may include, but is not limited to:

Note on Special Personal Information: Collection of Special Personal Information (as defined by POPIA and Gabon’s Law) is strictly limited to cases where it is:
- Voluntarily provided by you for lawful, explicit purposes (e.g., diversity reporting).
- Required by Gabonese, South African, or other applicable African law (e.g., to comply with employment equity legislation).
- Necessary to establish, exercise, or defend a right or obligation in law.
4. Principles of Lawful Processing
GSourcers commits to processing your Personal Data in adherence to the eight conditions for lawful processing as set out in POPIA and the principles of Law No. 025/2023, including:
- Accountability: GSourcers is responsible for ensuring compliance.
- Processing Limitation: Processing will be done lawfully and reasonably, minimally impacting your privacy.
- Purpose Specification: Data is collected for a specific, explicitly defined, and lawful purpose (recruitment) and will not be retained for longer than necessary.
- Information Quality: Data will be complete, accurate, not misleading, and updated where necessary.
- Security Safeguards: GSourcers shall implement and maintain appropriate technical and organisational measures to secure the integrity and confidentiality of Personal Data against loss, damage, or unauthorized access.
5. Transfer of Personal Data (Cross-Border)
You acknowledge that due to GSourcers’ operations and the pan-African scope of this application process, your Personal Data may be transferred to, stored, and processed in South Africa, Gabon, or other African countries where GSourcers operates or uses third-party services (e.g., Applicant Tracking Systems).
GSourcers shall only transfer your Personal Data to a third party or location outside of Gabon or South Africa if that location or recipient is subject to a law, corporate rule, or binding agreement that upholds substantially similar data protection principles to POPIA and Gabonese Law No. 025/2023.
6. Your Data Subject Rights
In line with POPIA, Gabonese law, and similar African data protection statutes, you have the right to:
- Access your Personal Data held by GSourcers.
- Request the correction, destruction, or deletion of your Personal Data (subject to legal retention requirements).
- Object to the processing of your Personal Data.
- Be notified if your Personal Data is subject to a data breach.
- Withdraw your consent at any time.
